NOTE: The booking conditions on this page refer to tours commencing in the 2021/2022 season.
OUR DUTY
1. Your Tour Reservation
-
On receipt of your deposit, subject to availability, Dala Sail will reserve your place on your selected tour. A contract is only made between you and us upon your booking being confirmed and accepted by us and our confirmation thereof to you.
2. If We Cancel or Change Your Tour
-
Dala Sail reserves the right to change or cancel your booking in accordance with operating requirements or circumstances beyond its control.
-
Should change or cancellation prove necessary we will give you reasonable notice thereof, in the circumstances, and where available, offer you a comparable alternative.
-
If an alternative is not available or acceptable you will be offered one of the following;
a) Refund of fare paid by you to us (less bank transaction fees),
b) Transfer to another Dala Sail tour without payment of any transfer fee, or
c) Travel Credit notice valid for 16 months. -
If the change or cancellation is due to force majeure (i.e. circumstances like political unrest, war or threat of war, riots, civil strife, closure of airports or ports, industrial disputes, terrorist activity, natural and nuclear disasters, fire, epidemic/pandemic or health risk, Acts of God, adverse weather conditions or other similar events beyond Dala Sail’s control) you will be offered one of the following;
a) Refund of fare paid by you to us less expenses (non-refundable deposit & bank transaction fees) incurred by us in respect of your booking with your non-refundable deposit converted to Travel Credit to be used on future trips with Dala Sail or,
b) Travel Credit notice (see 2.7 for Flexible terms) to be used on future trips with Dala Sail. In this instance, your travel insurance is responsible for covering any losses incurred. -
Dala Sail reserves the right in cancelling departures with less than 20 participants for the Philippine product, and changing ship name and configuration if need arises. Dala Sail is not responsible for the costs of any other travel arrangements affected due to our cancellations or rescheduling of any tour departure.

All refunds will be returned by the same method of payment made to Dala Sail through our online payment system.
We can not refund to another card or via bank transfer. If your bank can not accept the refund, your fare will remain as Travel Credit for future trips and made fully flexible as per our flexible terms for use (clause 2.7).
Any bank transaction fees charged on the original payment are not eligible for refund. Dala Sail can not be held responsible for any additional fees your bank may charge to accept this refund. Refund amounts are dependent on the bank’s currency conversion on the day. Dala Sail can not be held responsible for any gains or losses made by you in this transaction. -
Flexible terms for use of Travel Credit;
• Your Travel Credit is fully transferable for any future tour date.
• Name on your Travel Credit is fully transferable.
• Travel Credit can be split amongst multiple bookings.
• Travel Credit can be applied to any already discounted Sale fares.
• Travel Credit can not be redeemed for cash.
• No additional promo codes can be applied when using Travel Credit.
• Any remaining credit can be used towards any future bookings (valid for an additional 16 months). -
Covid-19 Policy:
• Risk Free Early-Bird bookings for 2021/2022 season. Fully refundable deposits in case of COVID-19 travel disturbances on all early-bird bookings made before December 31st 2020. You will be given the option to cancel your booking before making further payments.
Further payments will be due on March 31st 2021.
• Travel Credit & Refunds: If your tour gets postponed or you can't travel due to any COVID-19 restrictions, you may choose to keep your booking and receive bonus travel credit for future use on any tour in any destination, or cancel your spot entirely. If you choose to cancel your spot entirely, for any bookings made after July 1st 2021 your non-refundable deposit will no longer be forfeited, it will be converted to travel credit for use on any future tours, in any destination valid for 24mths.
3. Tour Details and Conditions

Dala Sail will do their best, at their discretion, to select accommodation, optional excursions and transportation to give you good value for money.

Dala Sail will endeavor to match you up with someone of the same sex when booked in a Share room configuration, but can not be guaranteed.
-
Dala Sail constantly strives to improve tour itineraries and features. If such improvements can be made, or unforeseen circumstances beyond our control make changes necessary, we reserve the right to vary itineraries. Dala Sail is not responsible for any other travel arrangements affected due to our cancellations.

We reserve the right to alter or substitute the type, the size of vessel and/or the style of transport mentioned in the brochure, resulting in occasionally having to utilise transport without some of the features promoted.
-
The Captain reserves the right in changing the route in case of bad weather conditions or on advice from local port authorities.
4. Liability

Your travel agent shall, on the receipt of any monies, hold such monies for you until the booking is confirmed at which time those monies shall be remitted promptly by your travel agent to us. All such monies received by us will be deposited as required by law.

All monies paid by you to us through your travel agent or otherwise, whether in respect of the deposit or full payment, may be disbursed by us as and when we see fit, in respect of the services to be provided and/or fees payable under the tour program. The payment of a deposit or any other monies in respect of your tour shall be deemed to be an authorisation for disbursement thereof as aforesaid.

5. Booking Your Tour

In order to reserve your tour, a deposit of AUD 500 (18,000 PHP) per person per tour, or the full amount payable if the booking is made within 60 days of your departure, must be submitted to Dala Sail by you in respect of that tour. This payment is in addition to any deposit required by your travel agent. The deposit is accepted as a first installment of the tour price by Dala Sail only once the booking has been confirmed in writing by Dala Sail or your travel agent.

Your reservation will be confirmed on receipt of a non refundable deposit of AUD 500 (18,000 PHP) per person per tour which must be within 4 days of booking or the reservation will automatically be cancelled. The remaining balance, full amount from which the deposited amount is deducted, is to be paid upon the date stated in the calculation/proforma invoice.

Your successful payment of your deposit will also act as confirmation that you have read and agree with these Terms & Booking Conditions.

Any special meal requirements will be made on a request basis only. Dala Sail cannot guarantee special meal requests nor will it assume any responsibility or liability if clients’ special meal requirements are not fulfilled.

You may also request additional information via email in regards to transfer and general transportation information from your arrival point to your cruise/program departure point. Dala Sail will assist you with additional information and possible organization if needed within its possibilities. However, Dala Sail does not include organized transfer from your arrival points to your departure points and back as part of the program when the requested service is not clearly stated in the service descriptions. Please contact Dala Sail by email in case you would like to receive further offers on your pre and post cruise needs. Dala Sail claim no liability on advice or information given for 3rd party programs

Making a reservation. Reserve your spot on any of our tours by booking via contact form/email. Select a desired route and departure date then contact Dala Sail via online contact form/email. Dala Sail will check availability and send an email confirmation to proceed with your booking.

Proceeding with Payment (Deposit or Full) online by credit or debit card (payment accepted in PHILIPPINE PESO only). 100% payment in advance by credit or debit card (Visa, MasterCard, Maestro) plus the standard processing fee (3.90%).

Booking correspondence is made by email. Customers take responsibility to set email filters to accept our email address. No extensions will be given for misplaced emails filtered into junk mail folders.
6. Paying the Balance
-
Online Payments - Credit Card Bookings: Payment can be made securely via our Online Payment gateway. Dala Sail will not request your credit card numbers/details at time of booking, nor will we keep any of your credit card details on file. The standard processing fee (3.75%) will be applied at the time of payment.

The balance of the tour must be paid no later than 60 days prior to your departure date which shall be by the due date stated on the confirmation issued to you by Dala Sail. Failure to make payment by the due date may result in your place being offered to our waitlist and forfeiting your non-refundable deposit.

Sale or Discounted fares: Full payment of these fares must be made by the due date issued for the Sale offer and will be outlined on the final invoice. If the deposit issue date is within 60 days of your departure date, the full cost of the tour will be payable immediately. Any discount promo codes must be used during the booking process. Discounts can not be applied after the booking is made, no exceptions.

Flexible Payment Plans are available on all fares. Payments are split into 3 even instalments. A once-off $30AUD setup fee will be added onto the first instalment. Final instalment must be completed by the due date stated on the final invoice. Secure payments are made via our online gateway with credit card only.

Philippine Sail product: Port Taxes & Supplements of AUD 180 per person (Php 6,500) due in cash on arrival. This applies to all bookings and will be outlined in the final invoice.

If payment isn’t made by the specified due date, Dala Sail reserves the right and may assume that you have cancelled your booking, inccurring cancellation charges in accordance with clause 7.3 below will be levied by Dala Sail.

Tickets and other documents won’t be forwarded until full payment has been received by us. The Final Travel Documents will be sent approximately 21 days prior to your tour departure date.

In the case of Late Bookings made within 45 days of your tour departure date, the full cost of the tour will be payable immediately on booking and we reserve the right to provide all travel documents at the tour departure point.

Dala Sail reserves the right to cancel the booking and apply cancellation charges should payments not be received within the above specified periods.
7. If You Cancel
-
Notice of cancellation must be made in writing (email) to Dala Sail.
-
If you cancel more than 61 days before departure, your deposit of AUD 500 (18,000 PHP) per person will not be refunded, nor can it be credited to any other booking.

Upon cancellation you will be liable to pay a fee to cover the estimate of cost and expenses incurred by us in the terms of the schedule set out hereunder. This is expressed as a percentage of the tour price and is calculated as follows:
More than 61 days notice: Deposit is forfeited.
60-46 days: 40% of tour fare is forfeited
45-31 days: 60% of tour fare is forfeited
30-16 days: 80% of tour fare is forfeited
15 or less: 100% of tour fare is forfeited

Where the percentage cancellation fee is less than the tour deposit, the cancellation fee will equal loss of deposit. If the reason for cancellation falls within the terms of any tour insurance policy which you hold, then any such charges may, subject to the terms of your insurance policy, be refunded to you by the insurance company.

Any cancellation of additional services within 14 days from the date of service, such as pre and post accommodation and transfers, will incur a 100% cancellation fee. For cancellation of additional services outside of 14 days from the date of service, please refer to the above cancellation policy.

These cancellation fees are in addition to any cancellation fees that may be levied by your travel agent. All Cancellation policies valid as at 24th March, 2020, and are subject to change. Final policy will be confirmed at the time of booking.

8. If You Change Your Booking

If after your booking has been confirmed and more than 60 days prior to tour departure, you wish to change to an alternate departure date or you wish to change to a different Dala Sail tour, you may do so subject to availability and provided the new tour date is still currently advertised.

A fee of AUD 100 per person will be charged for any revision or alteration made to a reservation after the booking is confirmed unless the change increases the value of the booking, in which case the difference must be paid.

A change of tour date or tour itinerary booking within 60 days of tour departure will be treated as a cancellation, and normal cancellation fees will apply except when the change is to a different departure date of equivalent or greater value in which case a AUD 100 per person amendment fee will be charged.
9. Tour Details and Conditions

Please read the tour details online carefully for those items included in the price. No allowance or refund can be made for meals, accommodation, excursions, etc. that you elect not to take, or when museums, shops, etc. are closed.

Legislation in various states in Australia, USA, Canada and the UK has highlighted the issue of Age Discrimination. In terms of style and content, all of Dala Sail’s tours are specifically designed for a particular age group. This fact should be recognised when you book one of our tours.

Dala Sail strives to provide a safe, enjoyable and memorable travel experience for all travellers. Dala Sail welcomes travellers with special needs or disabilities. However, please note the following:

Travellers are required to advise Dala Sail, in advance, of any physical, medical or other special needs that require accommodation.
-
All guests must ensure they are medically and physically fit for travel. Dala Sail may impose safety requirements necessary for the safe operation of the tour. Dala Sail may also exclude an individual from participating in a tour or an activity if that individual’s participation poses a direct threat to health or safety.
-
Dala Sail does not provide personal devices (such as wheelchairs, hearing aids or prescription eyeglasses) or services of a personal nature (such as pushing a wheelchair or assistance in eating, toileting or dressing). A companion capable of providing such assistance must accompany any passenger who require services of a personal nature.
-
Dala Sail does not employ medical personnel. Any necessary medical attention will be provided by a local facility at the passenger’s expense. Dala Sail is not responsible or liable for any losses or costs incurred as a result of medical services obtained while on tour, or for the quality of the care or services received.
-
Travellers should be aware some tours include rough terrain when on land, extensive walking over rocky roads, uneven surfaces, steps and locations which may not be easily accessible or accessible by wheelchair. During the tour, Dala Sail may make arrangements with carriers and other independent suppliers to provide travel services. These parties are independent entities over which Dala Sail has no control. Dala Sail cannot guarantee disability access or accommodations for all travellers.

Dala Sail may, at its sole discretion, decline the booking of any passenger or remove any passenger who cannot comply or refuses to comply with Dala Sail’s terms and conditions. Dala Sail is not responsible for any costs incurred in the event a passenger is removed from a tour. Passengers agree not to hold Dala Sail or any of its related entities liable for any actions taken under these booking conditions.

Due to specific mooring conditions and requirements in some ports, Dala Sail ships are moored away from the entrance area, making it necessary for the clients to use the dinghy in order to cross from our ship to shore. In such cases clients need to take special care when crossing. Crew assistance will be given to those needing and requesting it.

You are responsible for all travel arrangements and costs to/from the point of commencement/conclusion of the tour.
-
There may be times when the Dala Sail Representative has to make a decision in your best interests or the best interests of their group. You agree to comply with the authority and decisions of the appointed Dala Sail Representative and the laws of the country in which you are travelling. If you do not so comply or if, in the Dala Sail Representative’s opinion, you are not compatible with the general enjoyment and well being of other members on the tour or smooth operation of the tour itself, we reserve the right to refuse to let you continue with the tour. We do not tolerate the possession or carriage of illegal or restricted substances (drugs). Furthermore, you agree that your fellow travellers and any Dala Sail Representative has the right to travel/work in a safe environment. Any threats to their safety, well being or inappropriate behaviour by you, whether verbal or physical, will be taken extremely seriously and may result in the immediate termination of your tour. In either event, you will be responsible for your own repatriation and related costs and have no claims against us.

You are responsible for any costs incurred as a result of damage or excess cleaning fees related to your accommodation. You are advised to immediately report any pre-existing damage in your room to staff and/or a Dala Sail Representative as soon as it is discovered.

Guests are obliged to follow ship rules (found in written form on the ship) especially with regards to bringing drinks (alcoholic and non alcoholic) on board.
-
It is your responsibility to have a valid passport and all visas, permits and certificates required for your selected vacation as well as any necessary vaccinations and to comply with all applicable laws. Dala Sail is not responsible for any costs incurred as a result of failing to obtain necessary visas. Any costs whatsoever regarding obtaining, replacing or changing visas whilst on tour (including accommodation, meals, flights and transfers incurred due to associated delays) are at your own expense. Ensure you have at least 6 months validity remaining on your passport before you leave your home country. Many countries will not allow entry with anything less than 6 months remaining on your passport.
Dala Sail is/are under no obligation to assist with any phone calls to embassy's or extra documentation other than your final travel documents, to obtain your entry visa. -
You agree that our Dala Sail Representatives may take photographs and films of you while you are on tour and that these may be used in our brochures and/or advertising or publicity material without obtaining any further consent or payment in respect of such photographs and/or films.

If any provision of this contract is held invalid or unenforceable by any court of competent jurisdiction, that provision shall be deemed to be re-written to give effect to the same purpose within the permitted limits of the law. The validity and enforceability of the other provisions shall not be affected.
-
If you are unsuccessful in any legal action instituted against us, you agree to pay all our costs, including but not limited to, attorney/client costs.
-
Should you have a complaint in respect of the tour, you should inform the Dala Sail Representative during the course of the tour and if the matter cannot be resolved after the representative’s best endeavours to do so during the tour, your complaint should be certified by the ship, written in ships complaints book and sent to Dala Sail within 15 days from the customer’s departure. On the contrary, such complaints will not be taken into consideration. If you choose to write to Dala Sail via the Internet, please provide your home address so that we are able to reply to you in writing.

Should any dispute arise concerning this policy, the dispute will be determined in accordance with the laws of the Philippines and the States and Territories thereof. In relation to any such dispute the parties agree to submit to the jurisdiction of any competent court in Manila, Philippines.
10. Insurance
-
It is compulsory that you take out comprehensive insurance cover for cancellation, personal injury, death, medical expenses, repatriation expenses, force majeure and evacuation expenses before you travel on a Dala Sail tour. As a minimum, you agree to having adequate insurance that covers cancellation, personal liability and loss of personal property. Please ensure your insurance covers all of the activities that you are going to be participating in. Some policies exclude certain adventure activities.

We advise your Travel Insurance is arranged at the time of payment of the deposit as it will, in certain circumstances, cover you against loss of deposit or cancellation fees from the date of confirmation of your booking, as shown in the insurance policy. Dala Sail cannot be held responsible for your failure to take out appropriate insurance. You also agree to indemnify us against all third-party claims, actions, damages and remedies which may be brought against us in respect of your participation in the tour.

You will be required to provide your Travel Insurance details to us prior to receiving your final travel documents.
-
If your Travel Insurance is provided by your bank/credit card, we require details of that policy, including an emergency hotline number. Ensure this policy covers you for any excursions you may pay in cash, as some policies only cover you for items purchased on the card only.
11. Illness or Absenteeism

In the event of your withdrawal from a tour after the commencement as a result of illness, you must obtain a medical certificate in support of any insurance claim. No refunds will be made for any absence from the trip.
12. What’s Not Included In The Tour Price
-
Airfares to and from your tour destination, airport taxes, passport and visa fees, insurance, laundry, phone calls, beverages, personal expense money, medical fees, sightseeing, visits and entrance fees, meals not detailed in the itinerary, tips to Trip Managers, crew, representatives and local guides, items of a personal nature, excess baggage, optional excursions and anything else not listed in the ‘What’s Included’ section of the itinerary pages on the dalasail.com website
13. Weather Conditions

The Captain and the Dala Sail team reserves the right to change the route in case of unsafe weather conditions.
-
Under no circumstances can we be held responsible for snow or weather conditions, nor can any tour be cancelled or amended by you at any time on the basis of snow or weather conditions.
14. Special Note for All Cruises
-
Guests have to follow ship rules (to be found in written form on the ship) esp. with regards to not bringing drinks on board and in case of inappropriate behavior Dala Sail/captain reserves the right in asking clients to disembark

Dala Sail will not be responsible for any accidents that may occur onboard and insist that clients are informed of this and the need for extra observation and caution whilst being onboard or walking between ship(s) and mainland.
15. Ship Rules
-
Passengers on board are obliged to abide by the ship rules, as captain is responsible for the safety of all passengers and the crew. Captain has the right to change the itinerary in case of bad weather or similar inappropriate conditions in ports to ensure safety on board.
-
Passports are to be handed to the Captain for registration on the first day of the cruise and may be kept in possession by the Captain for use with documentation required by port authorities until the end of the tour.
-
Jumping or diving from the boat during navigation is strictly forbidden. For safety reasons climbing on the masts is also forbidden. Jumping from the boat when anchored is also forbidden, however jumping off the boat from the landing located at the back of the boat is done so at your own risk. Dala Sail holds no responsibility for any injuries incurred due to your decision to do so.

During rough weather movement should be done with care and as little as possible. The floors can often be wet and slippery. Passengers should take extra care. Do not hesitate to ask a crew member for assistance.
-
Safety jackets are on board. These are required to remain in their place for use in an emergency only and may not be removed for general use as a flotation device.
-
As the ships are explicitly acoustic all passengers are asked to behave accordingly. Special attention must be given to night peace onboard, which officially is at midnight. In National Parks even earlier night peace is required and guests will be notified of this.
-
Clients are responsible for looking after their personal belongings whilst travelling. The Operator cannot be held responsible for any personal belongings left behind or damaged on any trip irrespective of the circumstances. It is recommended you have a lock on your suitcase/baggage for you to store away any valuables.
-
Smoking in the restaurant area and in the cabins is forbidden.
-
Bed linens must not be taken out of the cabins.
-
Passengers are not permitted to bring drinks and food on the boat. This includes all drinks and food products purchased on shore in ports of call. The only exceptions are: personal care products, liquid medicine, food products specifically for infants and food products for special diets. Typical regional products purchased during visits to the ports will be stored on board to be returned to passengers at the end of the cruise.

Please take special attention not to throw anything into toilets except toilet paper.
-
Guests are obliged to respect meal times on board, which are placed on the board at specific times, as well as departure times to the next port.
-
Any damage must be compensated to the captain by the passenger. Lost cabin keys will be charged $100AUD per lost key.
-
It is strictly forbidden to throw rubbish into the sea.
-
Water is a problem on every boat, therefore please be very rational with it.
-
Guests must close the portholes in cabins under deck during navigation, to avoid their cabins getting wet by the sea water entering the cabin through the porthole.
-
The captain and the crew will be available for any questions or queries and will do their best to make your stay on board a most pleasurable one. If the captain and his crew are not providing satisfactory service, please contact our office for further help, as our aim is to make you satisfied during your stay onboard.

Service charge is not included in the price and therefore please tip your Dala Sail Representative and crew at your own discretion.
GENERAL
16. Contracting Parties
-
The Booking Conditions detailed herein contain the entire contract between you and Dala Sail. No representation, term, warranty or condition can be expressed or implied by reference to any other writing, advertisement or conversation. This contract may only be varied in writing by a duly authorised officer or director of Dala Sail.
-
Your contract is with us as the trip operating company. At any time and at our complete discretion we may nominate to you in writing any other company or person to have the benefit of some or all of those provisions of this contract, which we may then specify, as if you had agreed the provisions concerned directly with that company or person in the first place as well as agreeing them with us. We may at our complete discretion assign all or any rights and liabilities arising under or by virtue of this or any other contract with you.

Transportation companies, airlines etc. are not to be held responsible for any act, omission or event during the time travellers are not on board planes, transportation or conveyances. We rely on international convention, national and international law which may apply to the services provided by us, our suppliers or agents with respect to any claim of any nature brought by you against us as a result of the provision of those services. International conventions which apply may include: Warsaw Convention 1929, (as amended by Hague Protocol and Montreal Protocol) in relation to air travel, or Montreal Convention; the Berne Convention for rail travel; Athens Convention 1974 for carriage by sea; the Geneva Convention for carriage by road and the Paris Convention 1962 for Hotels. We are to be regarded as having all the benefits of these conventions on limiting our liability in relation to any claim for death, injury, loss, damage and delay to travellers and luggage. Enrollment in and payment for a tour shall constitute agreement and acceptance by the passenger of the terms and conditions set forth in this brochure which cannot be varied except in writing by an officer of the Company.

Dala Sail is not a carrier or hotelier nor does it own vessels, hotels or coaches. All bookings with carriers, hoteliers and other service providers are subject to the terms and conditions and limitations of liability imposed by those carriers, hoteliers, and other service providers. Please note that some of these limit or exclude liability in respect of death, personal injury, delay and loss or damage to baggage. Whilst we cannot accept any responsibility for any loss as a result of such actions or as a result of any act or omission of any such third-parties, we will give every reasonable assistance in helping to resolve any reasonable dispute. Please also note that Dala Sail cannot be held responsible for the failure of any of these parties to provide facilities or services for disabled clients (see also item 9.3 under Tour Details and Conditions).

Please note that no carrier depicted or recommended in this brochure by virtue of their endorsement of this brochure represent themselves either as contracting with any purchaser of a tour from Dala Sail or as having any other legal relationship with any such purchaser.

Every effort is made to ensure our website is accurate, however Dala Sail cannot be held responsible for typographical errors, or errors arising from unforeseen circumstances.
17. Validity

Dala Sail’s 2021/2022 Philippine programmes are valid from April 2020 - December 2022
18. Operating Companies
-
Dala Sail’s Philippine programmes are operated by Dala Sail Co. Ltd. The principle operator ILA Inc, their terms and conditions apply and are available on request.

Providing services according to the laws of the Philippines following the Customer protection laws that are related to the Contract that comes out of the online purchases by customers through this site.
